Welcome to Telly.
These Terms of Service (“Terms”) govern your use of the Telly application (“Telly”, “the App”), provided by Underlabs Inc. (“Underlabs”, “we”, “our”, or “us”).
By downloading, installing, or using Telly, you agree to these Terms. If you do not agree, do not use the App.
1. What Telly Is
Telly is an Apple TV media player and television organizer. To use your own media, you must configure a compatible M3U or Xtream source. Telly can also import programme guides associated with a source.
Telly does not provide television channels, movies, series, IPTV subscriptions, provider accounts or credentials, playlists, or programming.
2. Your Media Sources
You are responsible for selecting, configuring, and maintaining the media sources you use with Telly.
You represent that you have all rights, permissions, subscriptions, or other authorization necessary to access and use the media sources and content you connect to Telly. Possessing provider credentials alone does not establish that authorization.
Telly does not grant you any rights to content made available by a media source.
Underlabs does not verify, review, monitor, recommend, endorse, or certify user-configured IPTV providers or media sources.
3. No Content Provided by Underlabs
Underlabs does not:
- operate a television or streaming service;
- host or distribute television channels or media content;
- supply playlists, Xtream credentials, IPTV subscriptions, or provider accounts;
- recommend or endorse IPTV providers;
- proxy or relay media streams between providers and users.
Import and playback network communication occurs directly between your Apple TV and servers associated with the source you configure.
4. User Responsibilities
You agree to use Telly only in accordance with applicable laws and regulations.
You are solely responsible for:
- the media sources you configure;
- your provider credentials;
- compliance with any agreements you have with your media providers;
- ensuring that your use of media content is authorized.
You must not use Telly in any manner that violates applicable law or infringes the rights of others.
5. Availability of Media Sources
Media sources are operated by independent third parties.
Underlabs does not control the legality, reliability, accuracy, quality, or content of third-party sources and cannot guarantee their:
- availability;
- uptime;
- stream quality;
- channel listings;
- program guide accuracy;
- compatibility with every provider;
- uninterrupted playback.
Providers may change or discontinue their services at any time.
6. Purchases and access
Telly may offer 14 days of free access through Apple’s App Store. This free access period does not automatically renew, and its expiration alone does not cause a charge. Lifetime Access is a one-time in-app purchase, not a subscription.
Apple processes App Store purchases, which are also subject to applicable Apple and App Store terms. Eligible purchases can be restored through Apple’s purchase mechanisms where applicable.
When free access expires, catalogue browsing and playback require Lifetime Access. Expiration does not automatically delete your configured sources or personal library stored locally by Telly.
7. Software Updates
Underlabs may release updates, bug fixes, compatibility improvements, and new features.
Some updates may be required for continued compatibility with operating system changes or supported media formats.
8. Intellectual Property
Telly, including its software, user interface, design, graphics, logos, and original content, is owned by Underlabs Inc. or its licensors and is protected by applicable intellectual property laws.
These Terms grant you a limited, non-exclusive, non-transferable license to use the App for personal or authorized business use.
No ownership rights are transferred to you.
9. Third-Party Services
Telly may communicate directly with third-party media providers selected by you.
Telly may also use Apple system services required for App Store distribution and platform functionality.
Your use of third-party services is governed by their own terms and privacy policies.
Underlabs is not responsible for the availability or operation of third-party services.
10. Privacy
Your use of Telly is also governed by the Telly Privacy Policy, which explains how information is stored and processed.
11. Disclaimer of Warranties
Telly is provided on an “as is” and “as available” basis.
To the fullest extent permitted by applicable law, Underlabs disclaims all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Underlabs does not warrant that the App will operate without interruption, error, or incompatibility with every media source or provider.
12. Limitation of Liability
To the fullest extent permitted by applicable law, Underlabs shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to your use of Telly.
Underlabs is not responsible for:
- the availability of third-party media sources;
- media content supplied by third parties;
- interruptions caused by third-party providers;
- inaccuracies in playlists or program guides;
- loss of access resulting from provider changes.
Nothing in these Terms limits liability where such limitation is prohibited by applicable law.
13. Termination
You may stop using Telly at any time.
Access to Telly’s browsing and playback features depends on your StoreKit entitlement, as described above.
Termination does not affect any rights or obligations that arose before termination.
14. Changes to These Terms
We may update these Terms from time to time.
When material changes are made, the updated Terms will be published within the App or on the Telly website with a revised “Last updated” date.
Continued use of Telly after updated Terms become effective constitutes acceptance of the revised Terms.
15. Governing Law
These Terms are governed by the laws of the Province of Quebec and the applicable federal laws of Canada, without regard to conflict of law principles.
Any disputes arising from these Terms shall be resolved in the courts having jurisdiction in the Province of Quebec, unless applicable law requires otherwise.
